Denmark may be on the way to victory in the case concerning the Fehmarn Belt.
In any case, the Advocate General of the European Court of Justice on Thursday sided with Denmark in the case regarding state aid for the fixed link under the Fehmarn Belt.
The case arose because Denmark has supported the company behind the link with a number of capital injections, state loans, and state guarantees.
The European Commission decided in 2020 that this constituted state aid. However, the Commission also determined that it was compatible with the internal market.
Denmark has filed a case to have the claim of state aid annulled.
The court initially rejected this request in 2024. It was then appealed to the European Court of Justice.
In the proposed decision, the Advocate General of the European Court of Justice recommends that Denmark be upheld:
- Based on the above considerations, I propose that the Court uphold the appeal and annul the Commission's decision (...) regarding Denmark's state aid, writes the Advocate General.
The proposed decision is not final but is often followed by the court.
